Driver Policy – Orbits

Orbits Networks, Inc. (“Orbits”, “we”, “us”, or “our”) connects riders with independent drivers through our mobile application. Drivers using Orbits are independent contractors, not OUR employees.
1. Driver Eligibility
To register as a driver, you must:
- Be at least 19 years old
- Hold a valid NYS driver’s license and a TLC driver’s license
- Have a commercial vehicle registration
- Maintain a commercial insurance
- Have a valid TLC-licensed car (TLC – FHV – Permit)
- Pass background and identity verification
- upload a clear Profile Picture
- Comply with all local, state, and federal regulations
2. Driver Responsibilities
Drivers must:
- Maintain their vehicle in safe, clean and working condition
- Provide courteous and professional services to everyone (no discrimination is tolerated)
- Follow and obey all traffic laws and regulations
- Respect privacy and safety of riders
- Keep accurate documentation for identity, vehicle, and insurance
- Drivers cannot allow to refuse service due to an accompanying service animal.
3. Independent Contractor Status
Drivers acknowledge and agree that:
- They are not employees, agents, or representatives of Orbits
- Orbits does not control work schedules, rates, or methods of service of the drivers
- Drivers are responsible for their own taxes, insurance, and any other expenses
- Orbits is not responsible for any fine or traffic tickets
4. Trip Acceptance & Platform Use
- Drivers is directly assigned trips once they are online given all trip information (rider, pick-up, drop-off and earnings)
- Trips cancellations are very limited
- Misuse of the platform or fraudulent activity may result in suspension or deactivation
- Drivers must not circumvent Orbits payment systems
5. Safety & Insurance
- Drivers must maintain legally required a commercial insurance at all times
- Orbits provides in-app safety features, but does not provide a commercial insurance coverage
- Incidents should be reported immediately via the app or support contact
- Orbits is not responsible for any insurance claims or any related injuries happened during a trip.
6. Account Deactivation
Orbits may temporarily or permanently deactivate a driver account for:
- Violations of policies or Terms of Use
- Safety or legal concerns
- Fraud or misconduct
Drivers may appeal deactivation by contacting support@orbitsx.com, but Orbits reserves the right to make the final decision after a thorough investigation.
7. Data & Privacy
Drivers’ personal data is collected and processed according to the Orbits Privacy Policy.
Data may include identification, vehicle information, location during trips, and transaction records.
8. Governing Law
This Driver Policy is governed by the laws of the State of New York, USA.
Any disputes will be resolved in the courts located in New York.
